Terms of Service

Important: ClearBase provides informational data for situational awareness. It is not a replacement for official HMCG, RNLI, or maritime authority communications. Never rely solely on ClearBase data in a live emergency situation.

1. Acceptance

By downloading and using the ClearBase mobile application ("the App"), you agree to these Terms of Service. The App is provided by CosmoLabs Ltd ("we", "us", "our"), registered in Scotland, United Kingdom (Company No. SC883326).

2. Description of Service

ClearBase aggregates publicly available and licensed data sources — including AIS vessel positions, SAR aircraft tracking, Met Office weather, Admiralty tidal predictions, and what3words location services — to provide situational awareness for coastal professionals and emergency service volunteers. The App also provides crew location sharing functionality for operational groups.

3. Subscriptions and Pricing

ClearBase is available as a subscription service:

Subscriptions are managed via RevenueCat and billed through the App Store or Google Play. Pricing may change with 30 days' notice to active subscribers.

If you are unsatisfied with your subscription, you may request a refund within 14 days of the first paid charge by contacting support@cosmolabs.co.uk. This does not affect your statutory rights.

4. Nature of Data and Disclaimers

ClearBase aggregates third-party data that may be delayed, incomplete, or inaccurate. Specifically:

ClearBase is provided on an "as is" and "as available" basis. It is a supplementary situational awareness tool, not an authoritative emergency communications system.

5. Critical Safety Warning

ClearBase must not be used as the primary or sole source of information in emergency decision-making. Always follow official HMCG, RNLI, and local authority protocols. In a maritime emergency, contact HM Coastguard on Channel 16 VHF or call 999.

6. Limitation of Liability

To the maximum extent permitted by law, CosmoLabs Ltd shall not be liable for any loss, injury, or damage arising from reliance on ClearBase data, including any decision made during a search and rescue operation. Our total liability shall not exceed the subscription fees paid by you in the 12 months preceding any claim.

Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence.

7. Crew Location Sharing

Crew sessions are created voluntarily. By joining a session, you consent to sharing your real-time position with other session members. Session data is not stored after the session ends. You are responsible for ensuring that crew members consent to location sharing before adding them to a session.

ClearBase, including its code, design, and branding, is the property of CosmoLabs Ltd. Third-party data sources remain the property of their respective owners. what3words® is a registered trademark of what3words Limited.

10. Modifications

We may update the App and these Terms. Material changes will be communicated by email to registered users and displayed within the App. Continued use after changes constitutes acceptance.

11. Termination

You may cancel your subscription at any time via your App Store or Google Play account. Cancellation takes effect at the end of the current billing period. We reserve the right to suspend or terminate access for breach of these Terms.

12. Governing Law

These Terms are governed by the laws of Scotland and England and Wales. Disputes shall be subject to the jurisdiction of the courts of Scotland, unless mandatory consumer protection law in your jurisdiction provides otherwise.
